Navigating the Process

At your initial CST meeting the team will determine what evaluations, if any, the child requires.  Parents/guardians do not have to consent to the evaluations at the time of the meeting.  You have 15 days to consider the proposal.   Once the parent/guardian provides written consent , OPS has ninety (90) days to complete the evaluations and schedule an Eligibility meeting.   Parents/guardians must receive copies of the evaluations at least 10 days prior to the Eligibility meeting.

At the Eligibility meeting the CST will discuss the results of the evaluation(s) and propose either an Individualized Education Plan (IEP) or a 504 Plan.  Again, parents/guardians do not have to consent to the IEP or 504 Plan at the time of the meeting.  You have 15 days to consider the proposal.   Once the parent/guardian provides written consent the school can begin implementing services.

What what if I disagree with the evaluation(s)?

You may request one independent evaluation, to be completed by someone who is not employed by the District.  This evaluation can include as many (or as few) separate assessments as you deem necessary.  This independent evaluation is to be performed at the expense of the District.   If the District disagrees with the need for an independent evaluation they must ask for a due process hearing within 20 days of receipt of your request.

What is the different between an IEP and a 504 Plan?

Both an IEP and a 504 Plan offer formal help to children with academic, emotional, physical, or behavioral struggles.  They’re similar in some ways but quite different in others.  Below are some resources to help better explain how they work:
